DMCA Policy

Florida Renovate respects the intellectual property rights of others. We comply with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. We expect all users of our website to do the same. This policy outlines our procedures for addressing copyright infringement claims and counter-notifications.

Filing a DMCA Takedown Notice

If you believe that material hosted on floridarenovate.com infringes on your copyright, please send a written DMCA takedown notice to our Designated Copyright Agent. Your notice must include all of the following information for it to be valid:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the specific URL on floridarenovate.com).
  • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and email address.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

We review all valid notices promptly. Upon receiving a complete and accurate notice, we will remove or disable access to the infringing material. We will also notify the user who posted the content.

Counter-Notification Process

If your content was removed due to a copyright infringement notification, and you believe the removal was a mistake or misidentification, you may submit a counter-notification. A valid counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled. Include the location where the material appeared before it was removed or access was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, for any judicial district in which Florida Renovate may be found). You must also state that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receiving a valid counter-notification, we will forward a copy to the original complaining party. We will typically restore the removed material within 10-14 business days, unless the copyright owner files a court action seeking an order to restrain the user from engaging in infringing activity related to the material.
